Purchased amplifier, seller never shipped

Not sure if this is  the forum for my error in judgment but here it is.

It's been about a year since I sent money to Mivera Audio in Canada. I purchased 2 amplifiers, a 2 channel and a 6 channel amplifier that seller was building up for customers. He shipped the 2 channel after about a 6 month wait but never shipped the 6 channel. He refuses to refund our money of $3600 dollars. His excuse has been that the front panels are at the machine shop and that he had already purchased the parts for the amp. Again, it's been around one year since payment. I know of another fellow audiophile who has a similar experience was same seller. He was able to reclaim his money through Paypal I believe.

I'm trying to reclaim my money using the financial institutions that were used for payment. So far no luck. Any suggestions?

I'm located in the US, currently moving from San Jose to Las Vegas.
Thanks for that maratime51.
The 2 channel amp was anything but garbage. My audio buddy bought one and the amp came extremely well built with very nice components and internal cable.  I tried it and it sounded very nice in my system playing with a Lindemann Musicbook.

I'm just frustrated as hell and still hopeful this guy comes through.

But yes, took a chance.

Time for the poster to chime in.

Let me clarify my position on this seemingly hot topic.

First of all, I have not been following this thread. I should have, I started it. I'm buried in work and the challenges of moving and living in an RV with almost 0 internet. Fantastic

Two things. I was looking for a vehicle to pursue the return of my $3600 dollar investment in an amplifier that has no delivery date in site after a year since payment was started. That being around $3500 sent to seller by December 3rd of 2017. Upgrades he offered were added on as well as the optional 6 channel amp.

What seller was offering was a very IMO, technically and cosmetically solid piece of gear. And in the case of the 2 channel amp which I had in my system for a short time, fulfilled my expectations. It was not my amp and I will not give out those details. I will say again, damn good amp in my system and looked the part.

I’m a patient man. My wife too. Our primary mode of entertainment is music. We are not TV people. My 8 year old probably knows more about audio than most of you posters. We have been pretty involved in audio as a family for 15 years and for myself, 53 years. I have developed a solid core of audio friends in the SF Bay Area. I’ve made some great purchases and have been burned a few times. Perhaps it comes with the territory and occasionally doing business with smaller companies. But I like supporting small companies who have a passion in audio. Call me foolish if you will but I like the idea of spreading money this way. I love seeing small business folks prosper. But NOT at the expense of what I’ve been presented. Sound Decisions had graciously loaned us a Lindemann amplifier while our wait continued. That was in the summer. The amp broke. Sorry Sound decisions. Those guys are the best. They simply take care of business.

The business in question has a talented engineer that has proven that he can produce a state of the art product. And he had delivered for many. But NOT US. IMO he gets in the way of his own business. He consistently, defers, redirects, simply doesn’t take ownership of his business. Perhaps my tentacles run deep in the audiophile community even though I have not been posting reviews and or been a part of the community at hand. Funny too as I had planned an audio get-together at the home as we often do to give the 2 channel amp a listen which could have really helped the business in question. But time wore on and patience wore down.

I’m grateful for those who posted paths to help recover our money. Thank you. For some who offered nothing than “buying from PS Audio” well, I own PS Audio product and have bought in the past, PS Audio products. And that didn’t often work out well too. Cutting edge audio has its pitfalls. For the gentlemen who are enjoying their amps, good, you wouldn’t be if you never received one.

Mike, just do the right thing. Your business could do very well if you just treat customers as customers who give you their hard-earned money and get a product in a reasonable amount of time. We had sent you money because a few of us, that were a part of this transaction, recognized that you understood the fundamentals of producing an audio signal that might delight.

Oh and Mike, if you’re reading this and somehow you decide that returning our money is the correct action, then wait till after the year, when Xmas has past. We hope that your family will have a proper Christmas.

Merry Christmas Everyone!

Mike is refunding money paid for the 6 channel amplifier in dispute.
Thanks for the interest and those who were inclined to help solve this dispute.
Sorry for the gentlemen who got beat up supporting my position. Especially maritime51. What did that poster contribute to the audio forum?

We are in a life changing transition and balancing so much crap going on right now has been challenging. We miss listening to music. I'm hopeful anyone hear (whoops here:) can relate to that. But if you're reading this you're probably in a good situation. High end audio and all this crap. But we worked hard to enjoy music in its purest form right?

Honestly I thought I would get 3 posts regarding our dilemma. We just wanted to move on from this situation. I lost too much sleep over this, my therapist wife none. But then she wanted a "better" amplifier...

I'm hopeful this issue in the end helps Mike deal with business matters, and his business grows. Up to him. Killer amp for the money.

We're hopeful too to giving back to the community with crappy reviews about gear and especially cables. Not sorry cable haters, we hate nice cables too because they cost a lot.

Still trying to retire..

Happy Holidays to all
