Salamon67 describes the events as follows:
On June 21st I made offer to Xxx for his Aui\dio Research PH3 SE phono stage.
I paid the same day via Paypal.
I think unit arrived on June 26th I'm not sure since unit was shipped to my work and at the same time I was at the hospital so I did not put hand on it untill Friday.
I put unit into my system Friday night and I noticed one channel is pretty weak.
Since that is tube based unit and Xxx left tubes in the unit while shipped I checked tubes and inserted fresh tubes in the unit.

Unit was still acting the same way.

I also switched ICs and it was acting the same way.

Than I sent e-mail to Xxx asking him if he knows about that problem and if He can refund my money.

Salamon67 is requesting the following resultion:
I don't know if unit was damaged in the shipping or was working this way before it was shipped to me.
Fact is it never worked right in my possesion.

I would like to get full refund for it.
According to Audiogon rules I'm entitled to it.




Tiger describes the events as follows:
As I advised the Buyer, the unit was in perfect working condition when shipped having been fully tested in two different systems the day before shipping. Buyer attempted to resell the unit after receiving same by advertising on Audiogon as in perfect condition. After I brought that to the attention of the Buyer, he pulled the ad. Deceptive and deceitful. I then notified Audiogon of same, and advised them to investigate. Buyer has admitted he tempered with the unit, his damage? Changed IC and tubes. I will not accept return of the unit nor refund any part of the purchase price. E-mails on file to support this. Suggested the buyer have the unit fixed, if any thing is wrong with it as he claims, by sending it back to Audion Research for certification. Shipping to the buyer was in the original double box and then a third box was added. Unit thus was triple boxed. If the unit did not work properly, the buyer should have no tampered with it, advised me accordingly. Instead he re-advertised the unit, 'perfect working condition', as your ad file will prove. Dishonest.

Tiger's proposed resolution:
Sale is final no refund will be given. Buyer's actions preclude any other course of actions. I do not agree to any other resolution of the matter by audiogon or other party or terms other then I have outlined. Stupid, I am not.




Salamon67's rebuttal:
I did not tempered with unit changing tubes is normal thing with tube equipment. I changed tubes to check if there is any tube problem since they could be affected by shipping. Also unit came with tubes installed inside and according to Audio Research manual they should be removed and properly stored in sponge container before shipping. Also manual contains section how to troubleshoot this item and swapping tubes is suggested there. ICs are external interconnects which are connecting unit to preamp or integrated amplifier.
My ad does not have anything to do with fact that this unit is not working as it should upon arrival.
I think seller is responsible to deliver item to buyer in working condition, these are Audiogon rules.

Also to not to stiff anyone here on Audiogon I put that ad down.
Onec and again it does not matter unit does not work and it did not work properly when I put my hands on it.
At first I did not notice that since I hook it up to my equipment and I heard sound coming from both speakers.
i start doing some other things while music was playing and when at night I sit down to listen to it I noticed that ther is problem with left channel.
At first I thought they were tubes or ICs so I had some tubes which I put it in the unit but that did not help.
It was really late and I could not find brand new set of tubes that I had somewhere untill next day morning.
After I confirmed that changing tubes did not help I emailed seller next day morning around 9:00am that was 28th not 29th as seller and Audiogon stated.
I have all emails from seller.
Seller never try to "cooperate".
When he asked me why I pulled ad down I told him right away that I could not sale unit in this condition.
Ha blame me for all problems.
And again fact is unit never worked righ from beginnig.
