Audionut101 describes the events as follows:
sold this person a sub around the beginning of March 2003. this person put positive feedback on 3/7/03. Then he says there was a stratch with the sub. The sub I sold him was SEALED and unopened from the factory. A few weeks after the sale, he says he wanted some money from me since the price I sold it to him was too high. Then on 4/28/03 he put negative feedback. I thought I read somewhere that a person can only leave 1 feedback per transaction.
Audionut101 is requesting the following resultion:
remove negative feedback and suspend this user.
Phovenier describes the events as follows:
The sub I purchased was damanged, but I do (and did) acknowledge it looked to be sealed by the factory. It still worked great so I didn't make an issue of it since he told me he got the units on trade from a dealer for some other equipment, and that I bought the last sub available. He also said he was selling the gear due to changing his room design and needed to raising funds to cover a pending plasma purchase again due to the new room design. He apologized for the damage to the sub and offered to follow-up with the dealer and told me he would get back to me. A few weeks later, I emailed him on the progress with the dealer. He took about another week to reply and then apologized for being out of town. During that time I saw a few more adds from the seller, about additional new gear for sale and I then saw an add about having more earthquake subs, so I emailed him on the progress with the dealer and inquired about trading my damaged sub for one of the new ones since he had come into more subs or give me a small refund. He has not returned my emails and ignored me since. That was over a month ago.
My negative feedback was not about how he represented the sub (I believe he thought it was new), but how he handled the situation. If he would have told me he could not do anything, I would accept that, but he offered assistance and then ignored me.
Also, I contacted the manufacturer and was told the unit I have did not exist according to their records. A normal Earthquake sub should have SN on the sub amp, but on this one the SN was in the manual and according to the VP of Sales was not a vaild Earthquake SN. This can be verfied by contacting Earthquake. I'll provide a copy of my SN documentation if requested.
It is also worth noting I posted my experience with the seller in repsonse sales post of a similar sub on AVS Forum and the seller immediatly (within minutes) removed the offer to sell the product stating it was a bad post. Not once did he dispute my position, or contact me to discuss, or even post a reply to present his position, he just eliminated all offers to sell any equipment. I have copies of this post and can provide this data and emails as well if requested.
Phovenier's proposed resolution:
Keep the negative feedback since I do not consider the sub purchase a positive transaction and other users should be aware of how my transaction with the seller went. I purchased two items from this seller and the AMP was fine so I consider that transaction to be positive.
This is a joke. I told Phovenier that I had two subs for sale. And that he was purchasing one. I was in contact with him for a while, but I never did get his last e-mail and quite frankly since I did not hear from him I kind of forgot about the issue. I told him that I would inquire from the dealer that I got the sub from, which I did and the dealer states that he sold me brand new equipment. Since I didnt open the sub myself, I can not be 100% sure that the sub was not damaged, but more 99% of the time when it is sealed that way it usually is a good sign that the equipmenet is good.
All I would like to say is that from your rules, a person is only allowed to give one feedback per transaction. The original feedback was positive, the second one a month later is negative. The original feedback should stay as per your rules. This person should be suspended.
