Jadu1 vs Pmb: Submitted feedback is being contested
Problem: Submitted feedback is being contested
10-09-2002: Jadu1 initiated process
10-09-2002: Pmb submitted response

Jadu1 describes the events as follows:
aROUND MONTH BACK, i AGREED TO BUY THIS equipment, latter on on asking the serial# it turned out the preamp is almost 2 years old instead of 6 months as stated in ad, I convey this to seller , he agrees to reduce the price, than he demands the payment right away, I said let me check with ARC , than I will confirm the payment, please check my other feedback.if I'm wrong!

Jadu1 is requesting the following resultion:
I want the -vefeedback to be removed ASAP, as it it will ruin my repution!

Pmb describes the events as follows:
In dealing with this person I found that when he said he was going to send payment he did not. When I realised that I was mistaken about the age of the preamp I contacted him & agreed to reduce the price. I also changed the ad(you can verify this by your records)I was upfront with him re the preamp & the following is the summary of his email to me.Summary of email from Jadu on 9/9/02.Hi, got last e-mail I appriciate your honesty.
let me know if $2700 is OK with u I shall confirm the payment ASAP.
jadu1/XXX XXX XXXX. I accepted his offer. I sent him the address where to send the payment. By 9/19/ I had not received payment & asked him to advise.
On 9/19 I received an email from XXX stating he sent the check. On 9/25/ I still did not receive payment & asked him to advise. On 9/25/ He reaffirmed that the check is in the mail.On 9/25/ he stated that he was sending the cashiers check by Fedex "tomorrow". On 10/01 I still had not received payment.I telephoned him to find out where the check was. He said he would send it next week This is not what he had confirmed by email. He then admitted he never sent the money & he did not have the money. All of this can be confirmed by the emails I have saved. I do not understand why XXX had to lie about his financial circumstances & pretend that he was sending payment for several weeks. This is not an appropriate or ethical business practice & is the basis for my complaint.
XXX

Pmb's proposed resolution:
There is no resolution as XXX has admitted he cannot afford to make this purchase.

Jadu1's rebuttal:
WE had a telephonic conversation about checking the serial#
about the preamp, and than sending the check, it is totally wrong that he assumes my finacial circumstances for his mistakes!Above all if u should know the age of preamp when u r the orginal owner if its 6 months old or 24 months old!
when one is so wrong about its own ad, one should have pateince especially with Zero feedback, Noone can demand he wants the payment rightaway!
this the e-mail he sent to me after I said About checking with ARC!10/01
XXX
It is obvious that you are too poor to pay for the preamp. If you would like I will send your name and address and telephone number to one of the audiophile charities so that they may try to help you out of your desperate situation.
PMB
XXX 10/01
If stupidity were a virtue you would be a saint.
PMB
U only judge this person ,$2700 is quite a amount to spend
with person who misleads in the ad, and on asking about for pateince he just loses his mind, its not right or ethical!
one should be honest about his ad, if by error he thinks he has made mistake he should have pateice to let the buyer
know the reality!

While it may be true that no money changed hands it would be in the interest of future sellers like myself not to have the items they offer tied up by resellers or dealers while they are looking for customers. If Jadu had said upfront he was trying to resell the preamp then a decision about the time frame could have been reached amicably. To conceal his motives and lie is not appropriate nor in the best interest of any seller. Audiogon should discourage this kind of behavior so as to elevate it's own standards and reputation.

Re: Jadu1 vs Pmb: Submitted feedback is being contested

I agree with: (must pick one)
 Jadu1 completely, grant full request
 Jadu1 somewhat, grant partial request
 Pmb completely, grant full request
 Pmb somewhat, grant partial request
Both parties have valid points, compromise
Need more info, unable to find either way
