Gsusott describes the events as follows:
06/09 We agree on $1200 for the price.
06/09 I get approx. $1165 because the buyer used a credit card. The ad said plus shipping and I got no shipping amt.
06/10 I cancel the sale by email because I was upset about being underpaid.

Gsusott is requesting the following resultion:
The feedback is incorrect. I did not cancel to take another offer. I cancelled because I did not get $1200 plus shipping.




Kustoff describes the events as follows:
We agreed on price and that I would pay by PayPal. No mention of shipping occurred in our dialoge regarding sale or agreed final price. I pay agreed amount. THEN he sends email requesting $53 for shipping AND requesting Paypal fee which he'd not asked for when sale amount was agreed. I am travelling internationally so 48 hours elapses before I receive his email requesting this additional payment. When I receive the request, I do not argue ths additonal amount, and I make the additional payment by PayPal. Buyer accepts PayPal payment, then refunds it, complaining that I "underpaid" originally. Outraged that I did not "guess" at an amount he might want for shipping, he now refuses to sell me the unit. I had paid agreed amount, I also paid additional requested amount, when it was requested. Meantime buyer informs me that when he sold it to me he had no other buyers, but now he has 2 others willing to pay more than I did. Seller insists this has nothing to do with his decision to renege on sale to me. His stated reason for reneging on sale is not that I did not pay all amou8nts requested, but that I did not pay them in my initial payment to him. This is because I paid the ENTIRE amount we agreed about when finalizing the sale. His insistence that 2 late arriving buyers willing to pay more than he had already agreed to sell to me seems insincere.

Kustoff's proposed resolution:
He honors his committment to sell the unit at the price we mutually agreed. He sells me the unit at our previously agreed price. I agree to pay not only shipping amount subsequently requested, but also any Paypal fee he incurrs. (He claims that Paypal charges a fee to him if I use a credit card to pay Paypal, but charges nothing if I pay Paypal with a bank transfer. I did not know this, but can use the bank transfer method to pay Paypal if he prefers).




Gsusott's rebuttal:
No offers were considered before I cancelled the sale on 6-10. The unit is now sold to a buyer that first contacted me at least 24 hrs. after I cancelled. The feedback is incorrect. The sale was cancelled over a payment dispute, not so I could accept another offer.




As of 06-17-2002, Audiogon is requesting input from members regarding this dispute.

For Angela100, I didn't take it as an insult. I'm just suprised that so many posters think feedback that goes well beyond the facts is OK since this seems contrary to Audiogon policy. Your post seemed representative of the general feeling.

Yes I sold the unit on Audiogon. As I have repeated, the buyer first contacted me 2 days after I cancelled the deal. It sold for 1200 plus shipping or a total of 1213. He paid all fees.
